3. How we use your information and our legal reasons
Purpose | Information used | Legal reason (where the law requires one) |

Meeting legal requests and protecting our rights | Relevant records | Legal obligation; our legitimate interest in defending legal claims |
Where we rely on consent, you can withdraw it at any time. This does not affect anything we did before you withdrew it.
We do not use your information for automated decisions that have legal or similarly significant effects on you.
4. When we act for our clients
Some services involve personal information that belongs to our clients’ customers, not to us. Examples include reviews and review responses on a Google Business Profile, enquiries captured by an AI chatbot we set up, and leads passed to a client’s systems. White-label work for agencies also involves information about the agency’s clients.
In these cases we act on our client’s instructions, and the client is responsible for telling its own customers how their information is used. Data protection laws call our role a “processor”. We use that information only to provide the service. We will sign a data processing agreement with any client or partner agency that asks for one.
5. Cookies and similar technologies
Cookies are small files stored on your device. Similar technologies include scripts and embedded content that send information about your visit to another company.
Our website uses or loads the following third-party technologies. When your browser loads them, the provider receives technical information such as your IP address and browser type.
Technology | Provider | Purpose | Type |
Google Tag Manager | Loads tags on the website; at the last check it contained no active tags | Tag loader | |
Review widget | Trustindex | Displays our Google reviews and reviewer profile images | Third-party content |
Page-speed optimisation | NitroPack | Speeds up page delivery | Performance |
Forms | WPForms | Processes the forms on this website | Necessary |
Embedded map | Google Maps | Shows our location on the Kolkata page | Third-party content |
We do not currently use analytics or advertising cookies. If we add them, we will update this table first. We will ask for your consent before setting cookies that are not strictly necessary, wherever the law of your country requires it. You can also block or delete cookies in your browser settings; parts of the website may not work properly if you do.
6. Who we share information with
We do not sell your personal information, and we do not share it for third-party advertising. We share it only as follows:
- Service providers who help us run the business, such as website hosting, email, form processing, cloud storage, accounting, payment processing and messaging services. They may use the information only to provide their service to us. You can ask us for a current list.
- AI and SEO tools used to analyse websites and draft content and reports. We use these tools for the work you asked for. Where a tool offers a setting that stops it using our inputs to train its models, we turn that setting on.
- Platforms you ask us to work on, such as Google, YouTube, Meta or LinkedIn, when we publish content or make changes on your behalf.
- Contractors who help deliver services, bound by confidentiality.
- Professional advisers, such as accountants and lawyers, where needed.
- Authorities where the law requires it, or to protect our rights or someone’s safety.
- A buyer or successor if the business is sold or reorganised, under the same protections described here.
For white-label partners, we never contact or market to an agency’s clients directly.
7. International transfers
We are based in India and process information in India. Some of our service providers store or process information in other countries, which may have different data protection laws from yours. These include providers in the United States and the European Union.
Where the law of your country requires safeguards for such transfers, such as standard contractual clauses approved for transfers from the European Union or the United Kingdom, we put them in place. You can ask us for more information about these safeguards.
8. How long we keep information
We keep personal information only as long as we need it for the purposes in Section 3 or as the law requires.
Information | How long |
Enquiries and audit requests that do not lead to work | 24 months from our last contact |
Client records and correspondence | For the engagement, then 3 years for support and legal claims |
Invoices, payment and tax records | 8 years, which covers the periods Indian tax law requires |
Account access you granted us | Removed or handed back at the end of the engagement |
Blog comments | Until you ask us to remove them or the post is removed |
Website technical logs | Up to 12 months |
When information is no longer needed, we delete it or make it anonymous.
9. How we protect information
We take reasonable technical and organisational steps to protect personal information from loss, misuse and unauthorised access. These include limiting access to the people who need it and using the security features of the platforms we work in. We use two-factor authentication on our business accounts and remove account access we no longer need.
No method of storing or sending information online is completely secure, so we cannot guarantee absolute security.
10. Your rights
Depending on where you live, you may have the right to:
- Ask what personal information we hold about you and receive a copy.
- Ask us to correct, complete or update it.
- Ask us to delete it.
- Withdraw consent you have given.
- Object to our use of it, or ask us to restrict it, including an absolute right to object to direct marketing.
- Receive information you gave us in a portable format.
- Nominate another person to exercise your rights if you die or become unable to (India).
- Complain to us and to a data protection authority.
Some rights depend on the law that applies and on our reason for using the information. If we cannot meet a request, we will explain why.
Region-specific information:
- India: You can raise a grievance with our Grievance Officer (Section 1). If you are not satisfied with our response, you may complain to the Data Protection Board of India once the relevant provisions of the Digital Personal Data Protection Act, 2023 are in force.
- European Economic Area and United Kingdom: You may complain to your local data protection authority. In the UK this is the Information Commissioner’s Office (ico.org.uk). UK residents can also complain to us directly about our use of their information, using the details in Section 12. We will acknowledge a complaint within 30 days.
- United States: We do not sell personal information or share it for cross-context behavioural advertising. If a US state privacy law gives you rights over your information, you can use them by contacting us, and we will not treat you differently for doing so.
- Canada: You may contact the Office of the Privacy Commissioner of Canada.
- Australia: Where the Privacy Act 1988 applies to us, you may complain to the Office of the Australian Information Commissioner.
- New Zealand: You may complain to the Office of the Privacy Commissioner.
- Singapore, Japan, the United Arab Emirates, Saudi Arabia and other countries: You can use the rights your local law gives you by contacting us.
11. Marketing messages
Requesting a free audit or sending an enquiry does not add you to a marketing list. We send marketing emails or messages only where you have agreed or where the law otherwise allows it, and every marketing message tells you how to opt out. You can opt out at any time by replying “stop” or emailing info@technicalkalyan.com.
We will still send you messages needed to deliver a service you have bought, such as invoices and project updates.
12. How to make a request or complaint
Email info@technicalkalyan.com with the subject “Privacy request”, or send a WhatsApp message to +91 9088276890. Please tell us what you are asking for. We may need to confirm your identity before acting on a request.
We will respond within 30 days, or sooner if the law of your country requires it. If we need more time for a complex request, we will tell you why, where the law allows an extension.
13. Children
Our website and services are for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has sent us personal information, please contact us and we will delete it.
14. Data breaches
If a security breach affects your personal information, we will notify you and the relevant authorities where the law requires it, and within the time the law sets.
15. Links to other websites
Our website links to other websites and platforms. Their privacy practices are their own, so please read their policies.
16. Changes to this policy
We may update this policy when our practices or the law change. We will show the date of the latest update at the top of this page, and we will tell clients about significant changes directly.
